My Kadalys Regulation
1.Purpose:
The MyKadalys program is a customer loyalty program accessible via the website www.kadalys.com. It is managed by the company SHB, SAS with a capital of 118 182 € whose head office is located at 2 LOT POINSETTAS, PETER MAILLET, 97270 SAINT ESPRIT registered in the Trade and Companies Register of FORT DE FRANCE under the number 534 548 656.
The MyKadalys Loyalty Program allows customers who communicate/share certain information and/or buy certain Kadalys products, to accumulate points on an account, which can then be converted into gifts and/or advantages.
2.2 Membership to the MyKadalys loyalty program :
2.1. Conditions of membership :
The MyKadalys loyalty program is offered to any customer: natural person, aged 18 years old minimum and living in France (Corsica and Overseas included). It is not open to professionals (natural or legal persons).
The membership to the MyKadalys loyalty program is free, but it is conditioned to the placing of a first order.
To join the MyKadalys program, it is mandatory to provide a title, a name, a first name and a valid e-mail address. Customers will also have to create a password to access their account.
The registration will be confirmed by an e-mail sent to the e-mail address provided during the registration. The customer then becomes a member.
It is possible to create only one account with the same name, first name and e-mail address.
The account is nominative, personal and strictly reserved for private use.
The advantages linked to the membership to the MyKadalys loyalty program are only accessible on www.kadalys.com.
2.2 Terms of use :
The creation of a profile on the loyalty program MyKadalys implies the full and unconditional acceptance of the present rules.
The membership to the MyKadalys loyalty program can be validated in our computer file only if the information communicated on the membership questionnaire to the My adalys loyalty program are complete, readable and usable.
It is up to the members to keep their information up to date by logging on their personal space MyKadalys on www.kadalys.com. SHB can in no case be held responsible for the non-receipt of a loyalty offer by the member.
3. Personal data :
The following information is mandatory to join the MyKadalys loyalty program: title, name, first name, e-mail address. If you do not provide these data, you will not be able to participate to the MyKadalys loyalty program and receive offers or advantages.
It is not possible to use the same email address to create multiple profiles.
The other information requested at the time of the subscription is used to better know the member and, if necessary, to send him/her adapted communications but are not mandatory.
By subscribing to the MyKadalys loyalty program, the member agrees to the use of his personal data by SHB in the framework of this program, in particular to send him offers and information. The member of the program authorizes SHB company to make all necessary verifications concerning his identity or his residence.
In accordance with the provisions of the Law on Information Technology, Files and Freedom of 6 January 1978, SHB has declared its file to the CNIL. The member has the right to access, oppose and rectify his or her personal data by e-mail to contact@kadalys.com or by post to SHB SAS - 8 rue Lemercier - 75017 Paris.
The collection of information is declared to the CNIL under the number 1580978
4. Acquisition of My Kadalys points :
- his or her personnal information
- various interactions with the brand
- his purchases of the Kadalys Products on the website www.kadalys.com
Do not earn points:
- promotional offers
- 1 product free for 1 product purchased offers
Obtaining points for the MyKadalys loyalty program is exclusively done on the website www.kadalys.com.
Declarations by mail or telephone are not taken into account.
The acquired points are credited to the member's personal account.
Each member will have access to his points balance on his personal account MyKadalys on www.kadalys.com.
5. My Kadalys points scale :

5.1.1 Sharing
To earn points for a share on Facebook or Instagram of a page of the site, the member must be connected to his Facebook or Instagram account. The Facebook or Instagram account must be created with the same email address as the My Kadalys loyalty program registration.
5.1.2 Notices
To earn the 20 points, the reviews must be written while logged in on his MyKadalys account and be published on the website.
Only the reviews that :
- concern a different product/care (e.g.: 2 reviews on the same product will be counted as one review)
- are related to the commented product
- respect the law
It is not possible to receive points for more than 12 notices per year (12 months).
5.1.3 Sponsorship
It is not possible to sponsor people who are already members of the Club.
Self-sponsorship, which consists of creating several accounts in order to receive points, is prohibited.
Only one customer account per person and per computer is allowed.
SHB reserves the right to withdraw any points earned in the event of an illegal and/or fraudulent attempt to win.
5.1.4 Other
If an item is returned, the earnings will be deducted from the balance in an amount equal to the amount credited for the purchase.
6. Conversion of MyKadalys points:
The points accumulated on the member's account can be converted into gifts among the list of products proposed in the section "My gift", in the member's personal space, and within the limit of available stocks.
In order to benefit from his gift(s), the member can choose to integrate it (them) to an online order of products.
7. Modification of the MyKadalys Loyalty Program:
The SHB Company reserves the right to modify or cancel, at any time, the MyKadalys Loyalty Program (membership conditions, advantages...).
In case of termination of the MyKadalys Loyalty Program, the SHB Company will give to the members the possibility to use their remaining loyalty points during one month. If the member does not use his loyalty points, they will be definitively lost.
8. Fraudulent use:
Any breach of the present rules, any fraudulent use by the member of the MyKadalys loyalty program or by any third party acting on behalf of the member, will automatically lead to the deactivation and deletion of the loyalty account without any compensation or indemnity of any kind.
SHB reserves the right, in order to avoid fraud, to deactivate the account of a member of the loyalty program without the member being able to claim any compensation of any kind. SHB reserves the right to carry out, at any time, controls on the respect of the regulation.
9. No Waiver
The failure of either party to act under this Agreement shall not constitute a waiver of the right to act, unless expressly waived in writing.
10. Governing Law
These rules are governed by French law.
If any provision of these rules is deemed invalid, void or unenforceable for any reason, that provision shall be deemed severable from the rest of the rules and shall not affect the validity and enforceability of the remaining provisions.
In the absence of conciliation, any dispute relating to the interpretation or execution of these rules will be under the exclusive jurisdiction of the French courts.
